Vendors - Contract
Following is our Vendor Contract. This contract applies to all
exhibiting Vendors.

This Vendor contract is between the applicant, herein referred to as Vendor, You or Your and the Key Peninsula Community Fair Association herein referred to as the KPCFA.
DISPLAYS:
- All vendors and their personnel must remain within the confines of their own spaces and no vendors will be permitted to erect signs or display products obstructing the view, occasioning possible injury to, or disadvantageously affecting the display of other exhibitors.
- No signs, decorations, banners, advertising materials or exhibits will be permitted in aisles or passageways except with the written permission of the KPCFA.
BOOTH OPERATION:
- All vendor booths must be made of fire retardant material and must bear the UL fire retardant tag as stipulated by the Pierce County Fire Marshal.
- All booths must be securely anchored into the ground and supported by a weighting system. (the most reliable have been tubes filled with sand or gravel and hung from the tent supports). Bricks and building blocks are not permitted as either an anchoring system nor a weight system.
- Booth operators who produce forms of garbage must provide garbage collection containers and must see that they are emptied on a regular basis. A dumpster is provided in the paved area adjacent to the green building.
- All demonstrations and distribution of circulars or other promotional material must be confined to the limits of the vendor booth. Exhibits which include the operation of musical equipment, radios, sound motion picture equipment, public address systems or noise making devices must be operated at a reasonable decibel level, as determined appropriate by the KPCFA.
- No vendor may close a booth outside of the established hours of the event unless approved in advance by the KPCFA. Certain situations and emergencies during the fair can be accommodated by contacting the vendor coordinator or other KPCFA
Officer on site.
- The space contracted for is to be used solely for the Vendor(s) whose name appears on the contract. It is agreed that the vendor(s) will not sublet or assign any portion of same without written consent of the KPCFA.
- Concessions (food) vendors must comply with the rules and regulations set by the Pierce County Department of Health and the Pierce County Fire Marshal.
- While KPCFA provides a 24-hour security patrol for the protection of your exhibit property and vehicles, neither the show management, the facility management, nor KPCFA insurance are responsible for losses of any kind. KPCFA recommends that vendors carry their own insurance on booth contents and parked vehicles.
- The undersigned hereby agrees to hold harmless the KPCFA, its board members, its volunteers, Key Peninsula Metro Park District,
Key Peninsula civic Center Association, Key Peninsula Business
Association, or any persons involved with Key Peninsula Community Fair, from all claims, demands, damages, actions or causes of action, whether on account of property damage, theft, vandalism, act of God (weather), bodily injuries or death caused or contributed to by vendor participation in the fair.
- Any cancellation or changes must be in writing and received in our office no later than 30 days before Fair start date. A full refund will be granted for cancellations received prior to 30 days before Fair start date. Cancellations that arrive within 30 days of Fair start date will be accorded a refund less a $25.00 handling fee.
- The KPCFA reserves the right to restrict or remove exhibits, without refund, that have been misrepresented in application, operation, or are deemed to be unsuitable or objectionable. This applies but is not limited to noise, persons, animals, things, conduct, printed materials, or anything of a character that might be objectionable to the show or the management. Offenders will be asked to leave the fair without cause, reason, or refund if any of the terms are violated.
